Eligibility

You may be eligible for compensation if:

  • You have been injured as a result of a violent crime committed in Ontario. Your injuries may be physical or psychological.
  • You are responsible for the maintenance of a victim of crime who has suffered monetary loss or incurred expenses as a result of the injury.
  • You are the dependant of a deceased victim.
  • You are not a dependant of the victim but you have incurred expenses as a result of the death of the victim.
  • You were injured while trying to prevent a crime or while assisting a police officer in making an arrest.

Compensation may be awarded for:

  • Expenses incurred or to be incurred as a result of the victim’s injury or death. This would include the cost of counselling, physiotherapy, eye glasses, dentures, etc.
  • Emergency expenses incurred as a result of the victim’s injury or death. These expenses include such items as medical costs, funeral expenses and interim counselling.
  • Loss of wages up to $50 per day or a maximum of $250 per week in cases where total or partial disability affects the victim’s ability to work.
  • Financial loss to dependants of a deceased victim.
  • Pain and suffering.
  • Maintenance of a child born as a result of sexual assault.

To be eligible:

  • The claim must be filed within two years of the date of the incident. A request for an extension of this time limit may be granted.
  • The claim for a minor victim, one under 18 years of age, must be signed by a parent, guardian, legal representative or other responsible adult.

Compensation is not awarded for:

  • Property damage or theft.
  • An incident involving a motor vehicle.
  • Legal fees incurred for criminal and/or civil proceedings.

When assessing compensation the Board will consider if:

  • The victim’s behaviour caused or contributed to the injury or death.
  • The victim refused reasonable cooperation with or failed to report the offence promptly to the police.
  • The victim has received any benefits, compensation or indemnity paid by private insurance, the Workplace Safety and Insurance Board or any other source. This does not include Ontario Works or Ontario Disability Support Program.
